Advertising Terms and Conditions
CONDITIONS OF ACCEPTANCE

1. The web site www.mypropertypowerteam.co.uk is owned by Geogleam Limited and shall hereafter be termed MPPT for the purpose of this agreement. These conditions shall apply to all advertisements accepted for display on the web site. Any other proposed condition shall be void unless incorporated clearly in written instructions and specifically accepted by MPPT.

2. Excepting for the Advertisers’ own wording, logos and advertisements, MPPT retains the copyright of all material contained in the website and Directory and contained in any email broadcasts

3. All advertisements are accepted subject to MPPT’s approval of the copy and to the space being provided.

4. Bookings for advertisements are for a minimum of three months, except for site sponsorship which is for a one month period. Bookings are made by way of a partnership contract and may be cancelled prior to listings or advertisements being activated on this website. In this event, 50% of the agreed fee for whatever term will be payable. Once a listing or advertisement has been activated the booking is deemed to have been published and the agreed amount is payable in full.

5. Advertisement rates are subject to revision at any time and orders are accepted on condition that the price binds MPPT only in respect of the proceeding three months. In the event of a rate increase, the Advertiser will have the option to cancel the order without surcharge or continue the order at the revised advertisement rates.

6. If an Advertiser cancels the balance of a contract, except in the circumstances set out in clause 9, they relinquish any right to any discount to which they was previously entitled and advertisements will be paid for at the appropriate rates.

7. The due date for payment is prior to the advert being displayed. If the Advertiser wishes to continue the advertising contract beyond the date of the original term, the due date for payment is the day following the expiry the original contract. If accounts are not paid by the due date, MPPT reserves the right to make surcharges at the rate of 3% per month until payment is made. Should invoices remain unsettled, the Advertiser agrees to reimburse MPPT all associated debt collection costs incurred.

8. MPPT reserves the right to omit or suspend an advertisement at any time for good reason, in which case no claim on the part of any advertisers for damages or breach of contract shall arise. Should such omission or suspension be due to the act or default of the Advertiser, their Servants or Agents, then the space reserved for the advertisement shall be paid for in full notwithstanding that the advertisement has not appeared. Such omission or suspension shall be notified to the Advertiser as soon as possible. Without limitation, we reserve the right to remove from the website any information which we reasonably believe to be inaccurate, untrue, libelous, obscene, or a breach of copyright.

9. MPPT reserves the right to change, modify, redesign, restructure or otherwise change the website and its directory at any time, without prior notice. If MPPT considers it necessary to modify the space or alter position of the advertisement or make any other alteration, the Advertiser will have the right to cancel if the alterations requested are unacceptable, unless such changes are due to an emergency or circumstances beyond MPPT’s control. Every care is taken to avoid mistakes but MPPT cannot accept liability for any errors due to third parties, subcontractors or inaccurate instructions.

10. The Advertiser warrants that the advertisement does not contravene any Act of Parliament nor is it in any other way illegal or defamatory or an infringement of any other party’s right or an infringement of the British Code of Advertising Practice.

11. The Advertiser will indemnify MPPT fully in respect of any claim made against MPPT arising from the advertisement. MPPT will consult with the Advertiser as to the way in which such claims are handled.

12. In accepting financial advertisements, MPPT does so on the understanding that their copy content authorisation and placing have been processed in accordance with the requirements of the Financial Services and Markets Act 2000.

13. MPPT and its Agents will not accept liability for any errors due to inaccurate copy or copy instructions.

14. Charges will be made to the Advertiser or their Agent where the Graphic Designers are involved in extra production work owing to acts or defaults of the Advertiser or his Agent. The charges will be at the rates charged by the Graphic Designers.

15. Although MPPT take care to check information included in the website, it is the Advertiser’s responsibility to verify that information supplied to MPPT is correctly displayed and to inform us of any inaccuracies as soon as practicable. Complaints regarding placing or reproduction of advertisements must be in writing, and must be received within one calendar month of the day the advertisement appears on the web site.

16. Cancellation: Seven days notice in writing is required to stop or suspend an advertisement.

17. For the purpose of these conditions, ‘Advertiser’ shall refer to the Advertiser or his Agency whichever is the principal.

18. MPPT will market and promote the website for the benefit of Advertisers but nothing in these terms and conditions commits it to commencing or continuing particular campaigns and it reserves the right at all times to pursue marketing policies, which in its own judgement, it deems fit and suitable.

19. Content contained on this website is intended for UK use only and any information referring to tax or legal matters applies to the UK only. Any monetary amount contained within partnership contracts is in pounds sterling unless otherwise specified. Any overseas advertiser claiming exemption from VAT must provide us with details of their equivalent national VAT registration.

20. The Advertiser warrants that any information supplied to MPPT, to the best of its knowledge and belief, is free from any viruses or other content which is detrimental to the technical operation of the website.

21. MPPT does not give any warranty that this website or any other to which it is linked is free from viruses or any other known or unknown imperfections which may have a harmful effect on any technology. While we undertake to make our best endeavours to have this website available at all times, we cannot guarantee this and accept no liability for interruptions to service for any reasons.

22. The Advertiser warrants that it will protect the integrity of any password or passwords provided by MPPT that allows it to gain access to pages, and will not disclose that or those passwords to third parties or otherwise allow them unauthorised access to those pages.

23. To the fullest extent permitted by law, MPPT accept no liability for any loss, for whatever reason, direct or indirect, arising from use of this website.

24. By agreeing to these terms and conditions, the Advertiser warrants that all information supplied to MPPT about its firm, its services and about anybody who works in its firm, is accurate and does not breach the copyright or other legal rights of any individual or corporation. Further, the Advertiser agrees to indemnify MPPT against any loss which may arise from claims concerning any inaccuracy or breach of legal rights contained in the information it has supplied.

25. Signed partnership contracts constitute binding contracts between the parties These conditions and all other express terms of the contract shall be governed and constructed in accordance with the laws of England.
